Acceptance

By accessing fitnessblackbelt.com (the “Website”), creating an account, purchasing a service, or using any program or content, you agree to these Terms. If you do not agree, do not use the Website or Services.

01Who we are and what these Terms cover

Mahyar Ghasemi, doing business as Fitness Black Belt, is a sole proprietor with a principal place of business in Southern California, USA, operating fitnessblackbelt.com (“Fitness Black Belt,” “we,” “us,” or “our”). These Terms govern the Website and our online fitness services, including digital workout programs, personalized plans, assessments, coaching, educational materials, videos, messages, and related content (collectively, the “Services”).

The Services are educational fitness services. They are not medical care, physical therapy, diagnosis, treatment, emergency support, or a substitute for advice from a qualified health professional.

02Eligibility

The Services are offered only to adults. You must be at least 18 years old and legally able to enter a contract to purchase or use the Services. You confirm your age at checkout. Anyone under 18 may not create an account, make a purchase, submit personal information, or use the online Services, and we do not knowingly collect personal information from them.

We may request reasonable proof of age or identity. We may suspend or end access when eligibility cannot be verified, and we will close any account we learn belongs to a person under 18.

03Accounts and accurate information

You must provide accurate, current information and keep login credentials confidential. You are responsible for activity under your account and must promptly report suspected unauthorized access. One purchase is for one participant unless the offer expressly states otherwise.

04Orders, acceptance, and digital delivery

Your order is an offer to purchase. We may accept or decline it, including for pricing errors, unavailable services, suspected fraud, eligibility concerns, or safety concerns. An order is accepted when we send confirmation or provide access, whichever occurs first.

Digital materials may be delivered by account access, download, email, message, or another method disclosed at checkout. You are responsible for providing a working email address, compatible device, internet connection, and any equipment clearly identified before purchase.

05Payment

You authorize Mahyar Ghasemi, doing business as Fitness Black Belt, and the payment processor to charge the price, applicable taxes, and any clearly disclosed fees to the payment method you select. Prices are shown in U.S. dollars unless the checkout page states otherwise. Payment is due before access or work begins.

If a payment is declined, reversed, disputed, or overdue, we may pause delivery or access while the issue is resolved. You remain responsible for valid charges and amounts already earned, subject to applicable law.

06No automatic renewal unless clearly selected

A purchase does not renew automatically unless the specific offer and checkout page clearly disclose the renewal amount, frequency, cancellation method, and other legally required terms, and you affirmatively agree. Where no recurring terms are shown, the purchase is one-time.

07Refunds and “Service Start”

You may request cancellation before Service Start. Service Start means the earliest of:

To request a permitted cancellation or report a billing error, email info@fitnessblackbelt.com and include the purchaser’s name, order date, and a description of the issue. Do not send full card numbers, security codes, or account passwords.

08Scheduling, rescheduling, and missed sessions

Any appointment-specific cancellation, rescheduling, late-arrival, or no-show rule must be displayed before booking and becomes part of these Terms. If no appointment rule is displayed, email info@fitnessblackbelt.com before the scheduled time. Missed or late sessions may be treated as delivered to the extent allowed by law when a disclosed booking rule applies.

09Chargebacks and billing disputes

Please contact us first about a billing problem so we can investigate. This does not limit any legal right to dispute a charge with your financial institution. Filing a knowingly false or fraudulent payment dispute may result in account suspension and recovery of amounts lawfully owed. We may provide the payment processor with the order confirmation, policy acceptance record, access log, delivery record, communications, and other relevant evidence.

10Personal-use license

We grant you a limited, revocable, nonexclusive, nontransferable license to use purchased content for your personal fitness use during the access period stated in the offer. You may not copy, resell, publish, upload, share, teach from, distribute, sublicense, reverse engineer, or commercially exploit the content without our written permission.

11Your responsibilities

• Provide accurate information relevant to safe participation and follow instructions within your own abilities.
• Use appropriate space, equipment, footwear, supervision, and safety precautions.
• Stop immediately if you experience pain, chest discomfort, faintness, unusual shortness of breath, loss of coordination, or another concerning symptom, and seek appropriate medical help.
• Do not use the Services while impaired or in a way that endangers yourself or another person.
• Do not harass others, interfere with the Website, attempt unauthorized access, introduce malicious code, scrape content, or misuse another person’s account.

12Privacy

Our Privacy Policy explains how personal information is collected, used, shared, stored, and handled. The Privacy Policy is incorporated into these Terms. Do not send unnecessary medical records or highly sensitive information through ordinary email or social media messages.

13Third-party services and links

The Website may rely on payment processors, scheduling services, video platforms, social networks, or other third parties. Their services are governed by their own terms and privacy policies. We are not responsible for a third party’s independent acts or content, except where applicable law provides otherwise.

14No guaranteed results

Fitness outcomes vary based on health, consistency, nutrition, sleep, stress, technique, genetics, environment, and other factors. Testimonials and examples describe individual experiences and do not guarantee that you will achieve the same result. We do not promise weight loss, muscle gain, competition results, income, medical improvement, or any specific outcome.

15Health disclaimer and assumption of risk

Exercise involves inherent risks, including falls, strains, sprains, overexertion, aggravation of existing conditions, and serious injury. Before participating, you are responsible for determining—with a qualified health professional when appropriate—whether the activity is safe for you. By voluntarily participating, you acknowledge these risks and accept responsibility for choosing suitable intensity, equipment, and conditions.

To the fullest extent permitted by applicable law, you release Mahyar Ghasemi, doing business as Fitness Black Belt, and his coaches, contractors, and service providers from claims arising from ordinary and inherent risks of voluntary exercise, except claims that cannot legally be waived, including any liability that applicable law does not permit us to exclude.

16Disclaimer of warranties

To the fullest extent permitted by law, the Website and Services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. We do not warrant uninterrupted access, error-free content, compatibility with every device, or that the Services will meet every individual need. Some jurisdictions do not allow certain exclusions, so they may not apply to you.

17Limitation of liability

To the fullest extent permitted by law, Mahyar Ghasemi, doing business as Fitness Black Belt, will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of access. Our total liability arising from a specific purchase will not exceed the amount you paid for that purchase during the twelve months before the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.

18Indemnity

To the extent permitted by law, you agree to indemnify and hold Mahyar Ghasemi, doing business as Fitness Black Belt, harmless from third-party claims, losses, and reasonable costs arising from your unlawful misuse of the Services, infringement of another person’s rights, or material violation of these Terms. This section does not require you to indemnify us for our own unlawful conduct.

19Suspension and termination

We may suspend or terminate access for nonpayment, fraud, unsafe or abusive conduct, unauthorized sharing, infringement, or material violation of these Terms. We may also discontinue a Service. Any legally required refund or remedy remains available. Sections that logically survive termination—including payment obligations, intellectual property, disclaimers, liability limits, and dispute provisions—continue to apply.

20Changes to the Services or Terms

We may update the Services or these Terms. Material changes will apply prospectively and will be posted with a revised effective date or otherwise communicated as required by law. Changes will not retroactively reduce rights already earned under a completed purchase unless the law permits and you agree.

21Disputes and governing law

Before filing a claim, each party agrees to send a written description of the dispute to info@fitnessblackbelt.com and allow 30 days for a good-faith attempt to resolve it, unless urgent relief or a shorter legal deadline applies. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Claims may be brought in courts with lawful jurisdiction in California, except that mandatory consumer-protection rules and any right to use small claims court remain available.

22Miscellaneous

If any provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. A delay in enforcing a right is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a lawful business transfer. These Terms, the Privacy Policy, the Payment & Refund Policy, the Health Disclaimer, and any offer-specific terms accepted at checkout form the entire agreement for the Services.

Questions, permitted cancellation requests, dispute notices, and billing notices must be emailed to info@fitnessblackbelt.com. Business contact location: Southern California, USA. No street address is currently published. If applicable law requires a complete mailing or street address for a particular notice, registration, or customer transaction, that address must be provided before the relevant Service is offered.

Payment & Refund Policy

This policy forms part of the Terms above and applies to every paid program, assessment and coaching service sold through fitnessblackbelt.com.

Payment authorization

By submitting an order, you authorize Mahyar Ghasemi, doing business as Fitness Black Belt, and the payment processor to charge the displayed total, including applicable taxes and any clearly disclosed fees, to your selected payment method. Prices are in U.S. dollars unless checkout states otherwise. We never require you to send a full card number by email, text message, or social media.

When service starts

Service Start occurs at the earliest of:

Refund rule

You may request cancellation before Service Start. After Service Start, the payment is final and no full, partial, or prorated refund is provided because content, access, professional time, or customized work has been delivered or made available.

This rule does not remove rights that cannot legally be waived. We will provide a refund or correction when required by law or when we verify a duplicate charge, incorrect charge, or failure to provide the purchased Service.

How to report a problem

Email customer support at info@fitnessblackbelt.com. Include the purchaser’s name, order date, order number if available, and a description of the issue. Never send a full card number, password, or security code.

Failed payments and access

If payment is declined, reversed, disputed, or overdue, access or delivery may be paused while the matter is resolved. Any later charge requires authorization consistent with the checkout terms and applicable law.

Automatic renewal

This policy assumes one-time purchases. No automatic renewal applies unless the specific offer and checkout page clearly disclose the renewal price, frequency, cancellation method, and all legally required terms, and you affirmatively agree.

Health Disclaimer

Educational fitness information—not medical care

Fitness Black Belt provides general and personalized fitness education, exercise programming, coaching, and related content. We do not provide medical diagnosis, treatment, physical therapy, nutrition therapy, mental-health care, or emergency services. Information from a coach does not create a doctor-patient or other licensed-clinical relationship.

Get appropriate clearance before participating

Consult a physician or other qualified health professional before starting or changing an exercise program, especially if you are pregnant, injured, recovering from surgery, taking medication that affects exercise, or have a heart, lung, metabolic, neurological, musculoskeletal, or other medical condition.

Stop for warning symptoms

Stop exercising and seek appropriate medical help if you experience chest pain or pressure, fainting, severe or unusual shortness of breath, sudden weakness, confusion, loss of coordination, a new severe headache, acute injury, or any symptom that concerns you. Call local emergency services for a possible emergency. Do not use the Website or a coach’s message as emergency support.

Personal responsibility and equipment safety

You are responsible for selecting an appropriate level, following instructions within your abilities, using safe equipment and surroundings, and requesting clarification when needed. Online coaching cannot physically inspect your environment, equipment, or technique in the same way as in-person supervision.

Nutrition and supplements

Any general nutrition information is educational and is not individualized medical nutrition therapy. Consult an appropriately licensed professional for allergies, eating disorders, pregnancy, medication interactions, diagnosed conditions, or therapeutic diets. Fitness Black Belt does not guarantee the safety, purity, legality, or effectiveness of any supplement.

Results vary

Individual results vary. No testimonial, image, measurement, or statement guarantees a particular outcome. Exercise and nutrition decisions remain your responsibility, subject to rights and duties that applicable law does not allow either party to waive.

Voluntary participation and risk

Physical activity carries inherent risks, including soreness, falls, strains, sprains, overexertion, aggravation of an existing condition, and serious injury. By choosing to participate, you acknowledge these ordinary risks and agree to follow reasonable safety instructions. This acknowledgment does not waive rights that cannot legally be waived.
